EMPLOYER JOB OFFER CATEGORY – FOREIGN WORKER STREAM  

The foreign worker stream under employer job offer category is for foreign workers who has a full-time job offer in a skilled occupation that falls under National Occupation Classification (NOC) 0, A or B and who intend to live and work in the province of Ontario permanently.

 

Eligibility Requirements for Applicants.

  • Job Offer: Have a full-time job offer from an employer in Ontario. The National Occupational Classification (NOC) must be type 0, A or B.
  • Work Experience: Have a minimum of 2 years of directly related work experiences in the last 5 years.
    • The experience does not have to be continuous, and the 2 years of full-time experience is calculated by having a total of 3,120 hours (30 hours/week * 52 weeks/year * 2 years).
  • License: Have a valid license of authorization if required by the occupation on the job offer.
  • Intention to Live: Must intend to live in Ontario.
    • This can be identified by looking at your work, study, visit or volunteer experience in Ontario, personal relationships such as with close relatives living in Ontario and owning or leasing a property in Ontario.
  • Legal Status: Have a legal status in Canada if the applicant is currently residing in Canada.

 

Eligibility Requirements for Employers.

  • Have been an active business in the last 3 years.
  • Business location where the applicant will work is in Ontario.
  • Have no ongoing or outstanding orders made against them under the Ontario Employment Standards Act or the Occupational Health and Safety Act.
  • Demonstrate that sufficient amount of recruitment effort was made to hire locally if the applicant is not in Ontario.
  • A minimum of $1,000,000 of gross annual revenue is required if the business is located in Greater Toronto Area (City of Toronto, Peel regions, York, Halton and Durham).
  • A minimum of $500,000 of gross annual revenue is required if the business is located outside of Greater Toronto Area (City of Toronto, Peel regions, York, Halton and Durham).
  • Have at least 5 full-time employees who are Canadian citizen or permanent residents for businesses in Greater Toronto Area (City of Toronto, Peel regions, York, Halton and Durham.
  • Have at least 3 full-time employees who are Canadian citizen or permanent residents for businesses outside of Greater Toronto Area (City of Toronto, Peel regions, York, Halton and Durham.

 

EMPLOYER JOB OFFER CATEGORY – INTERNATIONAL STUDENT STREAM

The international student stream under employer job offer category is for international students who has a full-time job offer in a skilled occupation that falls under National Occupation Classification (NOC) 0, A or B and who intend to live and work in the province of Ontario permanently.

 

Eligibility Requirements for Applicants.

  • Education: Have a degree, diploma or certificate that takes at least one year to complete by studying on a full-time basis from an eligible Canadian institution.
    • The one-year certificate program must require a completed degree as an admission requirement.
  • Must submit the application within two years of completing the study program in Canada.
  • Job Offer: Have a full-time job offer from an employer in Ontario. The National Occupational Classification (NOC) must be type 0, A or B.
  • License: Have a valid license of authorization if required by the occupation on the job offer.
  • Intention to Live: Must intend to live in Ontario.
    • This can be identified by looking at your work, study, visit or volunteer experience in Ontario, personal relationships such as with close relatives living in Ontario and owning or leasing a property in Ontario.
  • Legal Status: Have a legal status in Canada if the applicant is currently residing in Canada.

HUMAN CAPITAL CATEGORY – HUMAN CAPITAL PRIORITIES STREAM

The human capital priorities stream under human capital category is for foreign workers who has skilled work experience, language ability and education and who intend to live and work in the province of Ontario permanently. The qualified applicant can apply for this program by creating a valid profile under IRCC’s (Immigration, Refugees and Citizenship Canada) Express Entry system and receiving a Notification of Interest from Ontario government.

 

Eligibility Requirements for Applicants.

  • Work Experience: Must be eligible under one of the two federal programs; Federal Skilled Workers Program (FSWP) and Canadian Experience Class (CEC).
    • FSWP: At least one year of full-time experience (1,560 hours) in the last 10 years in the candidate’s Express Entry profile. The occupation must fall under NOC 0, A or B.
    • CEC: At least one year of full-time experience (1,560 hours) in the last 3 years in the candidate’s Express Entry profile. The occupation must fall under NOC 0, A or B. The candidate must be in Canada with a valid legal status.
  • Education: Have bachelor’s, master’s or PhD degree in Canada or its equivalency in another country.
  • Language: Have a valid English or French language test result with a minimum of Canadian Language Benchmark (CLB) of 7.
  • Settlement Funds: Have a sufficient funds available to settle in Ontario. This can be proven by providing bank statements, job offer in Ontario and annual earnings from ongoing employment in Ontario.
  • Intention to Live: Must intend to live in Ontario.
    • This can be identified by looking at your work, study, visit or volunteer experience in Ontario, personal relationships such as with close relatives living in Ontario and owning or leasing a property in Ontario.
  • Legal Status: Have a legal status in Canada if the applicant is currently residing in Canada.

 

HUMAN CAPITAL CATEGORY – SKILLED TRADES STREAM

The human capital priorities stream under human capital category is for foreign workers who has Ontario work experience in eligible skilled trades and who intend to live and work in the province of Ontario permanently. The qualified applicant can apply for this program by creating a valid profile under IRCC’s (Immigration, Refugees and Citizenship Canada) Express Entry system and receiving a Notification of Interest from Ontario government.

  • Work Experience: At least one year of full-time experience (1,560 hours) in the last 2 years in Ontario in a skilled trade that falls under Minor Group 633 or Major Groups 72, 73 or 82 of NOC.
  • License: Have a valid license of authorization if required by the occupation on the job offer.
  • Current Residence: The applicant must be residing in Ontario.
  • Language: Have a valid English or French language test result with a minimum of Canadian Language Benchmark (CLB) of 5.
  • Settlement Funds: Have a sufficient funds available to settle in Ontario. This can be proven by providing bank statements, job offer in Ontario and annual earnings from ongoing employment in Ontario.
  • Intention to Live: Must intend to live in Ontario.
  • This can be identified by looking at your work, study, visit or volunteer experience in Ontario, personal relationships such as with close relatives living in Ontario and owning or leasing a property in Ontario.
  • Legal Status: Must have a work permit.

 

BUSINESS CATEGORY – ENTREPRENEUR STREAM  

The entrepreneur stream under business category is for entrepreneurs from outside of Canada that are interested in starting a new business or purchasing an existing business in Ontario. This program enables the entrepreneur and up to one foreign national business partner to have an opportunity to get nomination from Ontario government for permanent residence application.

 

Eligibility Requirements for Applicants (both Entrepreneur and Business Partner [If Applicable]).

  • Business Experience: Must have at least 2 years (24 months) of full-time business experience as a business owner or senior manager in the last 5 years (60 months).
    • Business owner: Had at least one-third of the business and had an active role.
    • Senior Manager: Had senior decision-making responsibilities.
  • Net Worth: Have a net worth of minimum of $800,000 CDN if the business is located in Greater Toronto Area (GTA) and $400,000 CDN if the business is located outside of GTA.
  • Personal Investment Funds & Equity: Have made a minimum personal investment of $600,000 CDN and control at least one-third of the equity in GTA. Have made a minimum personal investment of $200,000 CDN and control at least one-third of the equity outside of GTA.
  • Active Involvement: The candidate must be actively involved in the management of the business.
  • Capital Investment: The main intention of investment must be to make a profit, not to derive interest, dividends or capital gains.
  • Job Creation: Must create at least 2 permanent full-time jobs for local Canadians and permanent residents in GTA and 1 permanent full-time job for businesses outside of GTA.
  • Business Purchase Requirements: Must visit at least once in the last 12 months to see the business, the business that’s being purchased must be in operation in the last 60 months (5 years) from the previous owner, ownership of the business must be completely transferred to the new owner, must use 10% of the personal investment to improve or expand the business, and must keep all permanent full-time employees that used to work for the previous owner.

 

Eligibility Requirements for Businesses. 

  • Business Purpose: The main intention of the business must be to make a profit by providing goods and services.
  • Canadian and Ontario Legal Requirements: Must follow all legal due diligences such as Ontario’s labour and employment standards.
  • Permanent Business: The business must be permanent, which means it’s not project-based or seasonal.
  • Location: The business must be in Ontario.
  • Ineligible Types of Business: The business must not fall under one of the ineligible types listed by the Ontario government.
